These Terms of Service ("Terms") govern your use of the Gleam application ("Gleam", "the App") provided by Digital Raise ("we", "us", "our") on the Shopify platform.
By installing or using Gleam, you ("Merchant", "you") agree to these Terms.

1. The service
Gleam is a Shopify app that helps merchants:- Collect, moderate and display product reviews- Reward reviewers with automatically generated discount codes- Show user-generated content (UGC) photos on their storefront- Send transactional emails (thank-you, invitation, review-edit links)- Optionally analyse review sentiment using AI
We provide Gleam "as a service" hosted on Fly.io infrastructure in the EU.

3. Acceptable use
You agree NOT to use Gleam to:- Submit, display or curate reviews you know to be false or misleading- Incentivise reviews in a manner that violates Shopify's [Acceptable Use Policy](https://www.shopify.com/legal/aup) or local consumer law- Spam or harass shop visitors via the email features- Reverse-engineer, decompile, or attempt to extract source code- Use Gleam in connection with sites that promote violence, illegal activity, or hate speech- Resell or sublicense access to Gleam without our written permission
We reserve the right to suspend access if these terms are violated.

4. Your data and content
You retain ownership of all data and content you submit through Gleam (reviews, UGC photos, settings, brand assets). By using the App you grant us a limited license to:- Process your data to provide the service (display reviews, send emails, etc.)- Use anonymised, aggregated metrics to improve Gleam (e.g. average response times, error rates)
We will not use your reviews, customer data or shop content for marketing of our own services without explicit written consent.
When you uninstall the App, we delete all your shop's data within 48 hours per our Privacy Policy.

5. Service availability
We aim for 99.5% monthly uptime but do not guarantee uninterrupted service. We may need to perform maintenance, deploy updates, or address security issues that briefly interrupt the service. We will give reasonable notice for planned maintenance.
We are not liable for downtime caused by:- Shopify platform issues- Third-party sub-processors (Resend, Cloudinary, Anthropic, Fly.io)- Force majeure events- Issues caused by your custom theme or other apps

6. Limitation of liability
To the maximum extent permitted by law, Gleam and Digital Raise are not liable for:- Indirect, incidental, or consequential damages- Lost profits or revenue- Lost or corrupted data (although we maintain daily backups with 5-day retention)- Damages exceeding the amount you paid us in the 12 months preceding the claim
This does not limit liability for gross negligence or willful misconduct.

7. Indemnification
You agree to indemnify Digital Raise against claims by third parties (including your customers) arising from:- Your violation of these Terms- Your violation of any applicable law (including consumer protection, GDPR, advertising regulations)- Content you publish through Gleam (reviews, UGC photos, email templates)

8. Termination
You may uninstall Gleam at any time from your Shopify admin. We may terminate your access if:- You violate these Terms- Your account is more than 30 days past due on payment- Required by law or court order
On termination, your data is deleted per the Privacy Policy.

9. Changes to these Terms
We may update these Terms. The "Last updated" date reflects the latest version. Material changes will be communicated via email at least 30 days in advance. Continued use of Gleam after the effective date constitutes acceptance.

10. Governing law
These Terms are governed by the laws of the Netherlands. Any disputes arising from or relating to these Terms shall be submitted to the competent court in Amsterdam, the Netherlands.
